CINCINNATI, OHIO - JANUARY 12, 2011 - The Hamilton County Board of
Elections received a second court order from Federal Judge Dlott. The
court order was specific and clear on which votes must be counted.
The Board of Elections again communicated confusion over the specific
court order from the Federal Judge. The Board of Elections
communicated they did not know if they should follow the Secretary of
State or the Federal Judge. The republican Secretary of State was
sworn in 48 hours ago and ruled that no votes should be counted. "I
would like to refer the Board of Elections to the 1965 Voting Rights
Act. The Board refuses to recognize the Federal Court. All members
of the board voted today to review the new court order from Judge
Dlott and meet again on Friday at 10:00 AM," Christopher Smitherman,
president of the Cincinnati NAACP said.

The Board should be held in contempt of court immediately for defying
a second court order from Federal Judge Dlott. "This country is a
land of laws. Judge Dlott is a great judge and will not take kindly
this Board disrespecting her court. The Federal Government has always
had to protect the basic civil rights of African Americans in the
United States of America," Smitherman said.
